The National Council of Justice (CNJ) decided, in the 17th Ordinary Session of 2025, for the compulsory retirement of judge Luciano Américo Galvão Filho, of the Court of Justice of Alagoas (TJAL). The process investigated complaints of threats, physical aggressions and improper use of police apparatus in a possessory conflict that involved the magistrate. The unanimous decision of the Plenary followed the understanding of the rapporteur of the Disciplinary Administrative Process (PAD) 0002599-96.2024.2.00.0000, counselor Renata Gil.

The PAD originated from a complaint presented to the General Corregedory of Justice of the State of Alagoas by a lawyer who reported having been threatened by the magistrate during disagreements about the placement of a fence in the passage of a property. Also included in the investigation were reports of aggressions against employees who worked on the site, in addition to intimidation of private individuals with police support during working hours. Luciano denied the accusations and stated that he acted in legitimate defense, within the legal prerogatives.

In the vote, Renata Gil highlighted that the facts were proven during the instruction, emphasizing the seriousness of the conduct and the incompatibility with the dignity of the office. The counselor pointed out that the set of evidence showed the violation of functional duties.

The counselor Ulisses Rabaneda, who had asked for more time to analyze the case, presented, this Tuesday (9/12), a vote in which he fully accompanies the rapporteur's conclusion. In his notes, he considered that the set of elements demonstrated abuse of authority, improper use of police force and behavior incompatible with minimum ethical standards required of a magistrate. For him, the applied sanction “preserves the credibility of Justice and attends to the principle of proportionality.”

The CNJ will forward the judgment of the decision to the Attorney General's Office (AGU) and to the competent Public Ministry for eventual filing of criminal action or for administrative improbity, which may result in loss of the office and of the receipt of the retirement by the punished magistrate.

O Conselho Nacional de Justiça (CNJ) decidiu, na 17ª Sessão Ordinária de 2025, pela aposentadoria compulsória do juiz Luciano Américo Galvão Filho, do Tribunal de Justiça de Alagoas (TJAL). O processo apurou denúncias de ameaças, agressões físicas e uso indevido de aparato policial em um conflito possessório que envolveu o magistrado. A decisão unânime do Plenário seguiu o entendimento da relatora do Processo Administrativo Disciplinar (PAD) 0002599-96.2024.2.00.0000, conselheira Renata Gil. 

O PAD teve origem em reclamação apresentada à Corregedoria Geral da Justiça do Estado de Alagoas por advogado que relatou ter sido ameaçado pelo magistrado durante desentendimentos sobre a colocação de uma cerca na passagem de um imóvel. Também constaram na investigação relatos de agressões contra funcionários que trabalhavam no local, além de intimidação de particulares com apoio policial em horário de expediente. Luciano negou as acusações e afirmou ter agido em legítima defesa, dentro das prerrogativas legais.  

No voto, Renata Gil destacou que os fatos foram comprovados no curso da instrução, ressaltando a gravidade da conduta e a incompatibilidade com a dignidade do cargo. A conselheira apontou que o conjunto de provas evidenciaram a violação dos deveres funcionais.  

O conselheiro Ulisses Rabaneda, que havia pedido mais tempo para analisar o caso, apresentou, nesta terça-feira (9/12), voto em que acompanha integralmente a conclusão da relatora. Nos apontamentos, considerou que o conjunto de elementos demonstrou abuso de autoridade, uso indevido de força policial e comportamento incompatível com padrões mínimos éticos exigidos de um magistrado. Para ele, a sanção aplicada “preserva a credibilidade da Justiça e atende ao princípio da proporcionalidade”.  

O CNJ encaminhará o acórdão da decisão à Advocacia Geral da União (AGU) e ao Ministério Público competente para eventual ingresso de ação penal ou por improbidade administrativa, podendo resultar em perda do cargo e do recebimento da aposentadoria pelo magistrado punido.
