The Church of the Gardens, its advocate, and its members stand in support of the call for a federal and Washington State investigation of Washington State courts treatment of this family, which resulted in the death of a mother and the taking of real properties from her son; leaving him impoverished.  
One of the most glaring injustices revealed by this case is that neither Omana nor Krishna was afforded meaningful legal representation during these guardianship proceedings that resulted in Omana’s isolation, deterioration, and death, and the seizure of the family’s assets. 

 Also of concern is the role a senior judge assigned to this case by the United States District played in achieving this unjust outcome.

 In a nation governed by constitutional principles, no person—regardless of citizenship status—should be deprived of life, liberty, or property without due process of law. Due process, at a minimum, includes access to legal counsel when a person’s basic rights are at stake. 
The failure to provide counsel in these circumstances is not merely an administrative oversight—it is a systemic violation of rights.  
We urge unbiased observers, federal authorities, and the broader public to recognize that the international call for an investigation of the adjudication system utilized by Washington State is not a radical demand, but a deeply reasonable appeal from the international community to protect the “rule of law” from becoming a tool of oppression by those who intend protect the power of the wealthy.

Casey e Braun pedem exame das leis de tutela

Existem aproximadamente 1,3 milhões de tutelas de adultos nos Estados Unidos e cerca de 50 mil milhões de dólares em ativos sob acordos de tutela

Washington, DC –

 Hoje, o presidente do Comitê Especial do Senado dos EUA sobre o Envelhecimento, Bob Casey (D-PA), e o membro graduado Mike Braun (R-IN), enviaram uma carta ao Escritório de Prestação de Contas do Governo dos EUA (GAO) sobre as leis de tutela em todo o país. 

Estima-se que haja 1,3 milhão de idosos e pessoas com deficiência em regimes de tutela, que são relações jurídicas criadas quando um tribunal determina que uma pessoa é incapaz de tomar decisões importantes por conta própria.

 Considerando a falta de dados sobre tutelas nos EUA, os senadores Casey e Braun solicitaram que o GAO examine e informe sobre as leis de tutela em todo o país, o uso de tutelas e os esforços para reformar o sistema de tutela.

Depoimentos recentes da Comissão Especial do Senado sobre Envelhecimento e reportagens da mídia sugerem que abuso e fraude contra tutores podem ter efeitos devastadores. 

Tais abusos podem privar idosos, pessoas com deficiência e outros de seus direitos, de sua segurança financeira e até mesmo do contato com suas famílias.

“Embora muitos tutores cumpram suas obrigações, depoimentos e reportagens na mídia ilustram o lado obscuro das tutelas. 

Alguns adultos são colocados indevidamente em tutelas, que podem ser desnecessariamente restritivas e violar seus direitos. 

A situação das pessoas sob tutela pode ser 'mal monitorada de forma suficiente, significativa e diligente', resultando em 'exploração, abuso e negligência'”, escreveram os senadores.

A maioria das pessoas sob tutela são idosos e pessoas com deficiência.

 Muitos precisam de permissão para consultar um médico, tomar ou recusar medicamentos, morar em suas próprias casas, gastar seu próprio dinheiro e até votar. 

Eles também enfrentam maior risco de abuso, negligência e exploração por parte de tutores inescrupulosos. 

Os esforços para reformar os sistemas de tutela e as opções para os estados promoverem alternativas menos restritivas são variados em todo o país. 

O projeto de Lei foi arquivado por falta de apoio político.

When was the last time you saw or spoke to your mother?

Last time my sister and I spoke with her was on July 5, 2019. 

Please see attached complaint to know the details of what happened that day.

My attorney Ms. Candace Wilkerson arranged a visit on Feb 5, 2020 but she had been heavily sedated at that time.

When was the last time your sister, uncle, or any friend of yours spoke to or saw your mother?

My sister filed a habeas corpus while she was here in 2019 after she was held under false arrest for 6 hours by Harborview.

Where is the death certificate?

As you can see from attached federal motion, we never received a cause of death or a death certificate from the medical examiners office.

Who were the doctors responsible for the elderly in both shelters?

After our initial complaints, my belief is that she was transferred to a private facility.

The doctor there asked me to sign a release form to allow a visit.

Next we heard she was dead.

The release was a ruse to get impunity for murdering her.

They were victims of a system that  used judicial guardianship to isolate, torture and expropriate.

Omana is said to have died in 2023, after 5 years of torture and illegal isolation.

Krishna had his assets seized, was defamed and prevented from defending his mother in court.

Idosos e pessoas com deficiência estão sendo submetidos à  abusos, aprisionados, isolados da família por ordem judicial, torturados e assassinados por um sistema de curatela judicial corrupto nos Estados Unidos, que supostamente visa o esbulho de seus bens e de suas famílias. 

Estatísticas do Senado norte-americano mostram que existem centenas, talvez milhares, de pessoas nessas condições. 

Muitos idosos são desumanizados, privados de cuidados medicos e alimentação e até água, privados de seus direitos humanos mais básicos, à vida, saúde, liberdade, dignidade humana e amor, e deixados para morrer lentamente por "causas naturais " decorrentes de falta de água, alimentação, medicação e higiene pessoal, sedação química e tortura psicológica e física.

O caso de Omana Thankamma, que se acredita ter morrido após 5 anos de isolamento ilegal e negação de cuidados médicos, e de seu filho Jayakrishnan Krishna Nair, que teve seus bens tomados e foi impedido de defender sua mãe, é um grito de alerta.

Este não é um caso isolado, pois existem centenas de outros casos ja comprovados, o que evidencia a existência de graves distorção dos objetivos sistema de curatela judicial norte-americano e uma falha estrutural que viola os direitos humanos fundamentais.

Não podemos aceitar que seres humanos dignos sejam reduzidos a números de processo e sejam presos,  isolados de seus entes queridos sejam, explorados, torturados e mortos.

Exigimos:

 * Uma investigação criminal independente e imparcial.

 * A responsabilização de curadores, advogados, juízes e de todos os outros envolvidos no cerceamento de defesa e nos abusos praticados contra OMANA THANKAMMA, JAYAKRISHNAN KRISHNANAIR, sua irmã RAY e sua família.
 
* Reformas urgentes nas leis e nos TRIBUNAIS de JUSTIÇA norte-americanos para proteger os mais vulneráveis de abusos no sistema de curatela.

Juntos, podemos clamar por justiça para Omana Thankamma, Jayakrishnan Krishna Nair e para  todas as vítimas idosos,  deficientes físicos e suas famílias  que foram abusados e silenciados mediante fraudes judiciais.

O filme "I Care A Lot", sucesso da Netflix, retrata um caso de abuso e corrupção no sistema de curatela que, embora baseado em eventos reais, é  muito menos impactante do que o caso real de  tortura contra Omana Thankamma e seu filho Jayakrishnan Krishna Nair e sua família. 

As estatísticas disponíveis sobre pessoas sob curatela (tutela/tutela legal) nos Estados Unidos indicam que:

 * Existem aproximadamente 1.3 milhão de adultos sob alguma forma de curatela nos Estados Unidos, com cerca de US$ 50 bilhões em bens sob esses arranjos.

. No entanto, é importante notar que a falta de um sistema de coleta de dados nacional e abrangente significa que esses números são estimativas e o alcance total do problema não é totalmente conhecido.
