O poder judicial pode ser abusado e substituído pelo poder legislativo quando os juízes falham em aplicar a lei aos fatos reais perante o Tribunal. Isso ocorre porque se os juízes não estão decidindo questões diretamente envolvidas na disputa perante eles, eles estão exercendo poder geral, que visa controlar a conduta futura. Sem exigir que o poder judicial seja ancorado aos fatos de uma disputa que o Tribunal foi solicitado a decidir, um juiz está exercendo poder legislativo sob o disfarce de poder judicial. Em vez de aplicar a lei aos fatos, o juiz criou a lei e deu indevidamente o imprimatur do poder judicial ao próprio engrandecimento nu do poder do juiz não relacionado à sua função constitucional." [4]

Biography

Stafne graduated from DePauw University in 1971 and obtained his J.D. from the University of Iowa College of Law in 1974.

He also earned a Master of Law and Marine Affairs from the University of Washington in 1977.

Career

Stafne is the founder and owner of Stafne Law Firm, where he has practiced constitutional law, land use law, maritime and admiralty law, and personal injury law.

He also works as a maritime and fisheries expert and consultant for Pacific and North Pacific fishery management councils. [3]

Approach to Law

Stafne’s website provides a summary of his legal philosophy:

"The judiciary applies existing law to existing facts in order to determine things such as legal duties, defenses, and damages.

The judiciary can be abused and replaced by the legislature when judges fail to apply the law to the real facts before the Court.

This happens because if judges are not deciding issues directly involved in the dispute before them, they are exercising general power, which aims to control future conduct.

Without requiring the judiciary to be anchored to the facts of a dispute that the Court has been asked to decide, a judge is exercising legislative power under the guise of judicial power.

Instead of applying the law to the facts, the judge has created the law and improperly given the imprimatur of judicial power to the naked self-aggrandizement of the judge’s power, unrelated to his constitutional function." [4]

Stafne "believes that the Washington Supreme Court needs a new voice with deep legal experience that can restore better legal interpretations to our judicial system."

Achieving justice will not come from focusing on money. In fact, making justice lean towards money will ensure that the U.S. judicial system remains rigged and immoral.

Current Work

Scott currently works as an attorney for Stafne Law Advocacy and Consulting (SLAC), which is a religious auxiliary of COTG.

SLAC has the same mission as COTG, which includes filing legal petitions to protect the individuals identified in paragraph 4 of COTG's Mission Statement:

4) To minister to and protect those in need, such as the hungry, the sick, the poor, the homeless, the indebted, the enslaved, the vulnerable, and all others who are unjustly prevented from exercising their God-given inalienable natural rights.

The Church of the Gardens Attorney’s Office will continue to initiate and collaborate with others in the pursuit of litigation consistent with the Church’s mission.
