The institutional fight against corruption and structural deviations in the Brazilian Judiciary has fundamental milestones that require constant remembrance. 

In October 2011, the then National Inspector General of Justice, Minister Eliana Calmon, put her finger on the sore spot by denouncing the existence of criminals who tried to hide under the robes of the magistracy. 

To rescue this memory and keep the demand for justice alive — with special attention to the serious problems faced in the Judiciary of Rio de Janeiro —, we recall below the manifesto and the news that marked that period of intense national debates.

 'If you don't speak out, you don't correct it.'



In an excerpt from this oral history project, former minister Eliana Calmon recalls the behind-the-scenes approval of CNJ Resolution 135—a norm that standardized the punishment and oversight of magistrates in the country.

​When facing corporate resistance against the new rules, the former Inspector General's diagnosis was direct: the resolution was the least of it; the worst part was having to deal with the "bandits behind the robes."

​I summoned two retired appellate judges from São Paulo, because I wanted to demonstrate how much I valued the Judiciary Section of São Paulo, which I already knew would be the most difficult one for me to work with.

And what do you think of the Corregidor's Office?

So I spoke about the difficulties I was having, that I was facing Resolution 135. 

Now, for me, the worst thing of all are those bandits behind the robes. 

That's when, my friend, things got serious.

​My difficulties at the Corregidor's Office began early regarding these positions I took, which were contrary to the president of the CNJ. 

He believed that we had to correct ourselves internally, without saying anything. 

And I said: 'If you don't speak out, you don't correct it.'

​And when I said that, he started to push me aside, so much so that I was advised to talk to a Supreme Court minister, who was a minister in favor of the creation of the CNJ and had allied closely with Minister Nelson Jobim, who was the creator of the CNJ. And I went, and that minister then told me:

​'Dr. Eliana, you are going to have to rely on the press. If you don't rely on the press, you won't survive as Corregidor.'

​Following the approval of Resolution 135, everything improved considerably for the Corregidor's Office, because everyone got scared, because I started to avocated (assume jurisdiction over) cases."

Minister Eliana Calmon reaffirmed that criminals use the judiciary to hide.

Reducing the power of the CNJ will lead to
 impunity, says the inspector general.

At a Folha event on October 17, 2011, she reaffirmed that criminals use the judiciary to hide.

Impunity in cases of crimes committed by judges will increase if the investigative power of the CNJ (National Council of Justice) is diminished, said the council's inspector general, Minister Eliana Calmon, in a debate at the Folha auditorium.  

The statement was made in response to a lawsuit filed by the AMB (Brazilian Magistrates Association) in the STF (Supreme Federal Court), which seeks to limit the actions of the CNJ. 

Calmon explained that her statement was not generic, but reaffirmed that there are cases of criminals who try to hide behind the justice system, citing as an example serious episodes already combated by the inspectorates. 

"We don't have a society of saints, we have a society with a very strong moral erosion"


stated the inspector general, pointing out the country's "patrimonialist" tradition where the State is effectively plundered without much shame, reflecting inevitably within public powers.


The event was attended by the president of Apamagis (São Paulo Association of Magistrates), Paulo Dimas Mascaretti, and Senator Demóstenes Torres (DEM-GO), moderated by Folha's special reporter Frederico Vasconcelos. 

While representatives of the magistracy argued for limiting the scope of direct action of the CNJ in favor of local correctional bodies, defenders of external control emphasized that the council was constitutionally idealized precisely to combat corporatism and guarantee institutional transparency.

The NATIONAL MANIFESTO  and the Institutional Inquiry: 

In 2012, MINDD / Victims of Fake Condominiums brought the National Manifesto in Support of Minister Eliana Calmon directly to the National Inspectorate of Justice. 

The 'Manifesto Against Impunity for Judges!' was sent by email and delivered in person to the CNJ Corrections Office with signatures from citizens across various states, and the online petition was subsequently closed.

The MINDD's demand for effective responses and the confrontation of systemic irregularities never stopped. 

We presented an incisive questioning regarding the investigation of deviations in the Rio de Janeiro Judiciary ("Do you want to end corruption in the Rio Judiciary? Listen to us"), 

The fight for an upright, transparent, and truly republican justice system remains the fundamental foundation of our existence.
