10 Ai dos juízes injustos e dos que decretam leis injustas! 2 Daqueles que não deixam haver justiça para os pobres, para as viúvas e para os órfãos! Sim, porque a verdade é que chegam até a roubar as viúvas e os órfãos! 3 Que farão vocês, quando vier o castigo, nesse dia em que vier a desolação duma terra distante? Para quem hão de voltar-se para pedir ajuda? Onde vão pôr os vossos tesouros de forma a ficarem em segurança? 4 Nada podereis fazer, senão andar aos tropeções por entre os prisioneiros e cair por entre os mortos. Mesmo assim, a sua ira não desaparece. 1 Vós, filhos, sede obedientes a vossos pais no Senhor, porque isto é justo.

3 para que te vá bem, e vivas muito tempo sobre a terra.

4 E vós, pais, não provoqueis a ira a vossos filhos, mas criai-os na doutrina e admoestação do Senhor.

A armadura de Deus

10 No demais, irmãos meus, fortalecei-vos no Senhor e na força do seu poder.

11 Revesti-vos de toda a armadura de Deus, para que possais estar firmes contra as astutas ciladas do diabo;

12 porque não temos que lutar contra carne e sangue, mas, sim, contra os principados, contra as potestades, contra os príncipes das trevas deste século, contra as hostes espirituais da maldade, nos lugares celestiais.

13 Portanto, tomai toda a armadura de Deus, para que possais resistir no dia mau e, havendo feito tudo, ficar firmes.

14 Estai, pois, firmes, tendo cingidos os vossos lombos com a verdade, e vestida a couraça da justiça,

15 e calçados os pés na preparação do evangelho da paz;

A Proclamação da República completa 136 anos neste 15 de Novembro

Para historiadores, data é oportunidade para refletir sobre um País mais democrático e diverso, um ideal que, infelizmente, ainda não foi atingido no Brasil, 

Mas será, porque Deus é fiel.


LITURGIA DA MISSA 15.11.2025

A liturgia de sábado, 15 de novembro de 2025, tem como primeira leitura a passagem de Sabedoria 18,14-16.19,6-9. 

A passagem  de Sabedoria 18:14-16 descreve o início da praga final sobre os egípcios, onde o poder de Deus, representado por uma palavra poderosa, desce do céu e espalha a morte por toda parte. Este evento ocorreu durante a noite e assustou os egípcios com visões e temores, enquanto a palavra de Deus os atingia sem piedade, levando à ruína. 

Versículo 14: Descreve a noite como um momento de silêncio profundo, onde o poder de Deus, vindo do céu, desceu como um soldado implacável.

Versículo 15: Detalha como a palavra de Deus, comparada a uma espada afiada, foi lançada sobre um país condenado à destruição.

Versículo 16: Mostra a palavra de Deus em ação, espalhando a morte por toda parte e atingindo o céu e a terra. 

O Salmo responsorial é o Salmo 104 (105), com o refrão

 "Lembrai sempre as maravilhas do Senhor!".

 O Evangelho é o de Lucas 18,1-8, que narra a parábola do juiz iníquo e a viúva persistente, culminando na questão:

 "Quando o Filho do Homem vier, será que ainda vai encontrar fé sobre a terra?".

Quando um tranquilo silêncio 
envolvia todas as coisas
e a noite chegava ao meio de seu curso, a tua palavra onipotente,
vinda do alto do céu, do seu trono real, precipitou-se, como guerreiro impiedoso, no meio de uma terra condenada ao extermínio;
como espada afiada, levava teu decreto irrevogável;
defendendo-se, encheu tudo de morte e, mesmo estando sobre a terra, ela atingia o céu.

Então, a criação inteira, obediente às tuas ordens, foi de novo remodelada em cada espécie de seres, para que teus filhos fossem preservados de todo perigo.

Apareceu a nuvem para dar sombra ao acampamento, e a terra enxuta surgiu onde antes era água:
o mar Vermelho tornou-se caminho desimpedido, e as ondas violentas 
se transformaram em campo verdejante, por onde passaram, como um só povo, os que eram protegidos por tua mão,
contemplando coisas assombrosas.

Como cavalos soltos na pastagem
e como cordeiros, correndo aos saltos, glorificaram-te a ti, Senhor, seu libertador.

Light Shines on the Israelites

18 But for thy holy ones there was very great light.
Their enemies[a] heard their voices but did not see their forms,
and counted them happy for not having suffered,

2 and were thankful that thy holy ones,[b] though previously wronged, were doing them no injury; and they begged their pardon for having been at variance with them.[c]

3 Therefore thou didst provide a flaming pillar of fire
as a guide for thy people’s[d] unknown journey,
and a harmless sun for their glorious wandering.

4 For their enemies[e] deserved to be deprived of light and imprisoned in darkness, those who had kept thy sons imprisoned,
through whom the imperishable light of the law was to be given to the world.


The Death of the Egyptian Firstborn

5 When they had resolved to kill the babes of thy holy ones,
and one child had been exposed and rescued,
thou didst in punishment take away a multitude of their children;
and thou didst destroy them all together by a mighty flood.

6 That night was made known beforehand to our fathers,
so that they might rejoice in sure knowledge of the oaths in which they trusted.

7 The deliverance of the righteous and the destruction of their enemies
were expected by thy people.

8 For by the same means by which thou didst punish our enemies
thou didst call us to thyself and glorify us.

9 For in secret the holy children of good men offered sacrifices,
and with one accord agreed to the divine law,

both blessings and dangers;

15 thy all-powerful word leaped from heaven, from the royal throne,
into the midst of the land that was doomed,
a stern warrior

16 carrying the sharp sword of thy authentic command,
and stood and filled all things with death,
and touched heaven while standing on the earth.

17 Then at once apparitions in dreadful dreams greatly troubled them,
and unexpected fears assailed them;

18 and one here and another there, hurled down half dead,
made known why they were dying;

19 for the dreams which disturbed them forewarned them of this,
so that they might not perish without knowing why they suffered.


Threat of Annihilation in the Desert

20 The experience of death touched also the righteous,
and a plague came upon the multitude in the desert,
but the wrath did not long continue.

21 For a blameless man was quick to act as their champion;
he brought forward the shield of his ministry,
prayer and propitiation by incense;
he withstood the anger and put an end to the disaster,
showing that he was thy servant.

22 He conquered the wrath[g] not by strength of body,
and not by force of arms,
but by his word he subdued the punisher,
appealing to the oaths and covenants given to our fathers.

23 For when the dead had already fallen on one another in heaps,
he intervened and held back the wrath,
and cut off its way to the living.

24 For upon his long robe the whole world was depicted,
and the glories of the fathers were engraved on the four rows of stones,
and thy majesty on the diadem upon his head.

25 To these the destroyer yielded, these he[h] feared;
for merely to test the wrath was enough.


Wisdom 19 — RSVCE

The Red Sea

19 But the ungodly were assailed to the end by pitiless anger, for God[a] knew in advance even their future actions,

2 that, though they themselves had permitted[b] thy people to departand hastily sent them forth, they would change their minds and pursue them.

3 For while they were still busy at mourning, and were lamenting at the graves of their dead, they reached another foolish decision,and pursued as fugitives those whom they had begged and compelled to depart.

4 For the fate they deserved drew them on to this end, and made them forget what had happened, in order that they might fill up the punishment which their torments still lacked,

5 and that thy people might experience[c] an incredible journey, but they themselves might meet a strange death.

God Guides and Protects His People

6 For the whole creation in its nature was fashioned anew, complying with thy commands, that thy children[d] might be kept unharmed.

7 The cloud was seen overshadowing the camp,and dry land emerging where water had stood before,an unhindered way out of the Red Sea,and a grassy plain out of the raging waves,

8 where those protected by thy hand passed through as one nation,after gazing on marvelous wonders.

9 For they ranged like horses,and leaped like llambs, praising thee, O Lord, who didst deliver them.

10 For they still recalled the events of their sojourn, how instead of producing animals the earth brought forth gnats, and instead of fish the river spewed out vast numbers of frogs.

11 Afterward they saw also a new kind[e] of birds, when desire led them to ask for luxurious food;

12 for, to give them relief, quails came up from the sea.

The Punishment of the Egyptians

13 The punishments did not come upon the sinners without prior signs in the violence of thunder, for they justly suffered because of their wicked acts; for they practiced a more bitter hatred of strangers.

14 Others had refused to receive strangers when they came to them,but these made slaves of guests who were their benefactors.

15 And not only so, but punishment of some sort will come upon the former for their hostile reception of the aliens;

16 but the latter, after receiving them with festal celebrations, afflicted with terrible sufferings those who had already shared the same rights.

17 They were stricken also with loss of sight—just as were those at the door of the righteous man— when, surrounded by yawning darkness, each tried to find the way through his own door.

A New Harmony in Nature

18 For the elements changed[f] places with one another,as on a harp the notes vary the nature of the rhythm, while each note remains the same.[g]

This may be clearly inferred from the sight of what took place.

19 For land animals were transformed into water creatures, and creatures that swim moved over to the land.

20 Fire even in water retained its normal power, and water forgot its fire-quenching nature.

21 Flames, on the contrary, failed to consume the flesh of perishable creatures that walked among them,nor did they melt[h] the crystalline, easily melted kind of heavenly food.

Conclusion

22 For in everything, O Lord, thou hast exalted and glorified thy people;and thou hast not neglected to help them at all times and in all places.

Proclamação do Evangelho de Jesus Cristo segundo Lucas 


Naquele tempo, Jesus contou aos discípulos uma parábola, para mostrar-lhes a necessidade de rezar sempre, e nunca desistir, dizendo:

"Numa cidade havia um juiz  que não temia a Deus, e não respeitava homem algum.

Na mesma cidade havia uma viúva, que vinha à procura do juiz, pedindo:

'Faze-me justiça contra o meu adversário!'

Durante muito tempo, o juiz se recusou.

Por fim, ele pensou:

'Eu não temo a Deus,  e não respeito homem algum.

Mas esta viúva já me está aborrecendo.

Vou fazer-lhe justiça, para que ela não venha a agredir-me!'"

E o Senhor acrescentou:

"Escutai o que diz este juiz injusto.

E Deus, não fará justiça aos seus escolhidos, que dia e noite gritam por ele?

Será que vai fazê-los esperar?

Eu vos digo que Deus lhes fará justiça bem depressa.

Mas o Filho do homem, quando vier, será que ainda vai encontrar fé sobre a terra?"

At that time, Jesus told his disciples a parable to show them the need to pray always and never to give up, saying:

“In a certain city there was a judge who did not fear God and did not respect any man.

In the same city there was a widow who kept coming to the judge, saying:

‘Render justice for me against my adversary!’

For a long time, the judge refused.

Finally, he thought:

‘I do not fear God, and I do not respect any man.

But this widow is already annoying me.

I will render justice for her, so that she may not come and assault me!’”

And the Lord added:

“Listen to what this unjust judge says.

And will not God bring justice to his chosen ones, who cry out to him day and night?

Will he delay helping them?

I tell you, God will bring justice to them quickly.

But when the Son of Man comes, will he still find faith on earth?”



As palavras dos Papas

Trata-se de uma questão séria. Imaginemos que o Senhor venha hoje à terra: ele veria, infelizmente, tantas guerras, tanta pobreza e tantas desigualdades, e ao mesmo tempo grandes conquistas da tecnologia, meios modernos e pessoas sempre a correr, sem nunca parar. Mas será que ele encontraria aqueles que lhe dedicam tempo e afeto, aqueles que o colocam em primeiro lugar?

E, sobretudo, perguntemo-nos: se o Senhor viesse hoje, o que encontraria ele em mim — na minha vida, no meu coração? Que prioridades veria ele ordenadas em minha existência?

Nós, muitas vezes, concentramos nossa atenção em tantas coisas urgentes, mas desnecessárias; ocupamo-nos e preocupamo-nos com inúmeras realidades secundárias. E talvez, sem nos darmos conta, negligenciamos o que mais importa e permitimos que o nosso amor por Deus arrefeça — arrefeça pouco a pouco.

Hoje, Jesus oferece-nos o remédio para aquecer uma fé tíbia. E qual é o remédio? A oração.
A oração é o remédio da fé, a restauradora da alma. Deve, porém, ser uma oração constante.

Quantas vezes enviamos “pequenas mensagens” a pessoas que amamos! Façamo-lo também com o Senhor, para que o coração permaneça sempre ligado a Ele. E não nos esqueçamos de ler as suas respostas. O Senhor responde — sempre.

E onde encontramos essas respostas?
No Evangelho, que deve estar sempre à mão, para ser aberto algumas vezes durante o dia, de modo que possamos receber uma Palavra de vida dirigida a nós.

The words of the Popes


This is a serious matter. 

Let us imagine that the Lord comes to the earth today: 

he would see, unfortunately, so many wars, so much poverty and so many inequalities, and at the same time great technological achievements, modern means, and people always running, never stopping; 

but would he find those who dedicate time and affection to him, those who place him in the first place?

And above all, let us ask ourselves: if the Lord came today, what would he find in me, in my life, in my heart? 

What priorities in my life would he see? 

We often concentrate on so many urgent but unnecessary things, we occupy and worry ourselves with many secondary realities; 

and perhaps, without realizing it, we neglect what matters most and allow our love for God to grow cold, to grow cold little by little.

Today Jesus offers us the remedy to warm up a lukewarm faith. 

And what is the remedy?

Prayer.

Prayer is the remedy of faith, the restorer of the soul. 

It must, however, be constant prayer. 

How many times we send “little messages” to people we love! 

Let us do the same with the Lord, so that the heart may remain connected to Him. 

And let us not forget to read his answers. 

The Lord answers, always. 

Where do we find them?

In the Gospel, which must always be at hand to be opened a few times during the day, to receive a Word of life addressed to us.

🇧🇷 ANÁLISE (VERSÃO EM PORTUGUÊS)

A palavra do Papa Francisco e foco na corrupção judicial nos EUA e no Brasil

A mensagem espiritual contida no texto bíblico — iluminada agora pelas palavras firmes do Papa Francisco — revela um ponto central: Deus não é indiferente à injustiça institucionalizada.

 Ele vê, conhece e julga cada ato humano, especialmente quando cometido por aqueles que deveriam ser instrumentos de equidade e retidão, mas se desviam para a iniquidade.

O Papa Francisco tem repetidamente denunciado a corrupção como “um processo de morte”, afirmando:

“A corrupção é uma forma de blasfêmia. É uma praga que deforma o coração e destrói a esperança dos mais frágeis. Deus vê e julgará.”
(Papa Francisco, diversas homilias e discursos sobre corrupção e justiça)

Essas palavras se aplicam com precisão cirúrgica ao cenário atual — tanto no Brasil quanto no Estado de Washington, nos tribunais estaduais e federais e na Washington State Bar Association (WS Bar).


🔥 1. Cegueira Judicial Deliberada: um pecado antigo com roupagem moderna

A cegueira judicial deliberada — isto é, a recusa consciente de ver aquilo que está diante dos olhos — tornou-se uma epidemia institucional.

  • Juízes que ignoram provas.
  • Tribunais que protegem elites e punem denunciantes.
  • Órgãos disciplinares que operam como instrumentos políticos, não como guardiões éticos.

Essa cegueira não é inocente.


É deliberada, estratégica e conveniente para manter estruturas de poder e para sufocar quem denuncia injustiças.

Nos EUA, isso se expressa no sistema judicial de Washington State, que tem sido acusado de:

  • perseguir advogados que defendem pobres e vulneráveis,
  • atacar profissionais que denunciam corrupção institucional,
  • usar processos disciplinares como arma política,
  • fechar os olhos a fraudes sistêmicas em foreclosures, guardianships e family courts.

Esse padrão é idêntico ao que acontece no Brasil — onde perseguições políticas, distorções processuais, liminares abusivas, blindagem institucional e manipulação de procedimentos ocorrem para proteger redes de poder local, especialmente nos casos das vítimas dos falsos condomínios comary, dentre  muitos outros.


🔥 2. O Caso de Scott Erik Stafne e a Igreja dos Jardins

Scott Erik Stafne e a Igreja dos Jardins se tornaram alvos porque:

  • defendem gratuitamente pobres e oprimidos,
  • denunciam corrupção judicial sistêmica,
  • expõem abusos em execuções de foreclosure,
  • revelam violações constitucionais dentro de tribunais,
  • proclamam que o Estado de Direito deveria proteger — e não destruir — o cidadão comum.

O resultado é conhecido:
perseguição política pela WS Bar e hostilidade judicial dentro do próprio sistema que deveria garantir neutralidade.

A estratégia é sempre a mesma:

  1. Atacar o mensageiro para silenciar a mensagem.
  2. Manipular procedimentos disciplinares para intimidar.
  3. Criar narrativas de desqualificação moral.
  4. Usar a máquina do Estado para punir quem denuncia.

Exatamente o que você enfrenta no Brasil:
um sistema que se protege, se retroalimenta e pune quem ousa expor a verdade.


🔥 3. O Paralelo entre EUA e Brasil: a mesma corrupção sistêmica, com sotaques diferentes

Apesar das diferenças culturais, legais e institucionais, há um padrão universal:

Quando o poder judicial se torna cúmplice do poder econômico e político, os vulneráveis perdem toda proteção.

No Brasil:

  • Perseguições judiciais por denunciar corrupção.
  • Liminares ilegais.
  • Conluio de agentes públicos.
  • Falsos condomínios.
  • Fraudes imobiliárias.
  • Blindagem de juízes e promotores.

Nos EUA:

  • Foreclosures fraudulentas.
  • Guardianships usados para controlar bens de idosos.
  • Family courts que destroem vidas sem devido processo.
  • Advogados retaliados por defender pobres.
  • Bar associations operando como polícia política.

A raiz é a mesma:
corrupção estrutural alimentada por cegueira judicial deliberada.

10. Conscious irresponsibility 


The central point of Minister Schietti’s statement is profound:


it is not ignorance — it is conscious.


When:


the law is clear;


jurisprudence is consolidated;


the CNJ issues a manual;


the STJ repeats the doctrine hundreds of times…


…and even so judges, prosecutors, and police insist on repeating the error, we face civil, administrative, and criminal responsibility.


CONCLUSION: when the State errs consciously, it is not a mistake — it is a violation of human rights


This case should mark the beginning of:


the CNJ opening a national procedure;


the Public Prosecutor’s Office revising protocols;


the police reformulating practices;


lower courts complying with Constitutional Amendment 45 and binding precedents;


society demanding accountability and reparation.

For Minister Rogerio Schietti, of the Superior Court of Justice, the laziness and irresponsibility of Brazilian judges, who do not apply the jurisprudence on personal identification, have led to the maintenance of unjust imprisonments and unfounded accusations.


Schietti criticized disregard for jurisprudence on personal identification.

“Innocent people are being kept in prison due to the irresponsibility of professionals who should honor the salary they receive, but who are bowing to laziness or to a lack of diligence in pursuing an understanding that has been outdated for five years.”

The outburst was made during the session of the 6th Panel of the STJ this Tuesday (11/11), in the judgment of a special appeal against a decision of the Rio de Janeiro Court of Justice that upheld the conviction of a man who was the victim of systemic injustice.

A doorman was accused of more than 70 crimes exclusively based on a photo taken from his Facebook profile and presented by the Rio police in a “suspect album.”

Personal identification

In 2023, the 3rd Section of the STJ recognized the systematic violation of the man’s procedural guarantees, since personal identification in all these cases was not carried out as required by article 226 of the Code of Criminal Procedure. Since 2020, the STJ has understood that photo identification does not replace personal identification and cannot serve as evidence. This year, this position became binding.

Under the law, the person who will identify a suspect must see similar-looking people placed side by side and point them out without a shadow of doubt.

When the STJ analyzed the suspect’s case, it ordered the Rio court to review all the proceedings in which he was accused. So far, there have been acquittals in 51 of them, rejection of two indictments, one dismissal of charges, and two successful criminal reviews.

There are still 14 entries remaining on his criminal record. One of them was overturned by the 6th Panel of the STJ on Tuesday, with the granting of the special appeal filed by the Rio Public Defender’s Office.

Reporting judge of the appeal, Schietti highlighted that this judicial error destroyed the doorman’s life: at age 32, he continues to bear the stigma of being a criminal, spent three years in prison, lost contact with his young daughter, and lives confined at home, still the target of criminal cases.

Widespread laziness

In his vote, the minister cited research data by lawyer David Metzker, which indicate that, in 2025 alone, the STJ granted relief in Habeas Corpus 234 times to apply the jurisprudence on personal identification.

Of these cases, 70 (30% of the total) come from Rio de Janeiro, which demonstrates disobedience not only to the STJ but also to the rules approved by the National Council of Justice, which created a procedures manual to avoid judicial errors caused by faulty identification.

The data also show that, in Rio cases where it is possible to identify the position of the Federal Public Prosecutor’s Office — in the capacity of guardian of the law, and not as a party —, 70% issue opinions denying relief.

With this, the 6th Panel decided to report the Rio case to the CNJ so that it takes measures to “sensitize those who insist on persevering in an understanding” that is already outdated both jurisprudentially and administratively, according to Schietti.

Perhaps a time will come when public agents will be held civilly, administratively, and criminally liable. Because sentencing someone to prison in the face of all this normative framework, this massive jurisprudence, is at the very least a conscious irresponsibility. It is not out of ignorance. It is conscious, and this needs to change.”

By unanimity, the 6th Panel of the STJ acquitted Paulo Alberto da Silva Costa, convicted of robbery based solely on a photographic identification carried out without observing the legal criteria provided in article 226 of the Code of Criminal Procedure.

The rapporteur, Minister Rogerio Schietti Cruz, stated that the case “may be the most emblematic example of the dysfunctionality of the Brazilian criminal justice system” and criticized the continued issuance of convictions grounded on invalid evidence.

> “Legal professionals, from the early investigative stage to the highest levels of judicial review, must be more than empathetic: they must be responsible. They are not dealing with papers; they are keeping innocent people in prison.”

The minister further ordered the decision to be sent to the National Justice Council (CNJ) so that it may adopt concrete measures in light of the resistance of authorities to apply the precedent from the 3rd Section in Theme 1,258, which considers identifications carried out in violation of the law to be invalid.

Understanding the case

The Rio de Janeiro Public Defender’s Office appealed to the STJ after the Rio State Court of Justice (TJ/RJ) upheld Paulo Alberto’s conviction, even after the STJ's 3rd Section, in 2023, recognized that he was the victim of “systemic procedural violence” in several proceedings based exclusively on irregular personal identifications.

The only piece of evidence supporting the accusation was a Facebook photo used in a show up identification conducted without forming a group of similar-looking individuals.

The victims had described a Black, thin man, aged 20 to 25, 1.75 m tall, whereas the defendant was 32 years old and 1.85 m tall at the time of the facts.

In court:

two victims did not recognize him,

a third pointed to him only at the hearing, with no formal written record prepared.

And yet, even with no other corroborating evidence, the state court maintained the conviction in December 2024.

Repeated disregard for the law and precedent

In his vote, Schietti noted that on that same day, the CNJ had created the National Observatory to Prevent Judicial Errors and Wrongful Convictions, under the direction of Counselor Daniela Madeira and coordinated by Minister Edson Fachin — an initiative which he said “offers hope that things may change course.”

The minister reported the following facts:

Paulo Alberto spent three years in prison.

He was acquitted in 51 criminal cases.

He had two complaints dismissed, two criminal reviews upheld, and one non-indictment decision.

He still has 14 duplicated entries in his criminal record.

He was indicted in over 60 investigations, despite never being heard at a police station and never being found with any illicit object.

Schietti stressed the devastating impact:

> “This man’s life, after three years in prison, is over. He can no longer go outside, lost contact with his daughter, and now lives secluded, still burdened by records and proceedings arising from an unfounded accusation.

Conscious irresponsibility

The rapporteur highlighted that even after the judgment in HC 598,886, which established the mandatory observance of article 226 of the CPP, the STJ recorded 234 decisions in 2025 involving identification procedures — 70 of them from the State of Rio de Janeiro.

And in 70% of these cases, the Federal Prosecution Service (MPF) issued an opinion against granting relief, even where the identification was the only evidence.


For the minister, authorities’ insistence on ignoring established jurisprudence constitutes:


> “Conscious irresponsibility".

And he declared:

> “Maybe the moment will come when public agents will be held civilly, administratively, and criminally liable. Because sentencing someone to prison, to confinement, given the overall legal framework and the massive jurisprudence on the matter, is at the very least conscious irresponsibility. It is not ignorance — it is deliberate, and this must change.”


Schietti added that the CNJ, the STJ and the Supreme Federal Court have been working to correct these distortions, but that resistance persists among judges and members of the prosecution.

Measures ordered

Schietti suggested that the CNJ be formally notified of the decision to adopt awareness and oversight measures ensuring the proper application of jurisprudence.

The 6th Panel unanimously followed the rapporteur, granting the special appeal to acquit Paulo Alberto da Silva Costa, and reaffirming the understanding of Theme 1,258, according to which identification procedures conducted in violation of article 226 of the CPP are invalid and cannot support a conviction.
