US DISTRICT COURT SOUTHERN DISTRICT OF NEW YORK - American Friends Service Committee et al. vs. Donald J. Trump et al. - Complaint
Scott E Stafne
Abstract
The following plaintiffs are challenging President Trump's February 6, 2025, Executive Order 14203, which authorized sanctions relating to the International Criminal Court (ICC):
The American Friends Service Committee,
The Center for Constitutional Rights,
Human Rights Watch, and
The Open Society Institute.
The Plaintiffs Complaint raises five main challenges:
1. Ultra vires executive action: The plaintiffs contend that the President exceeded the authority Congress granted under the International Emergency Economic Powers Act.
2. Administrative Procedure Act violations: They argue that the sanctions designations are arbitrary, capricious, and contrary to law.
3. First Amendment violations: They claim that the sanctions suppress protected speech, association, advocacy, and legal assistance.
4. Religious Freedom Restoration Act violations: The Quaker organization alleges interference with its religiously motivated humanitarian activities.
5. Constitutional vagueness: The plaintiffs contend that the sanctions fail to give adequate notice of what activities are prohibited.
These are allegations, not findings by the court.
