Em Evans v. Gore, 253 U.S. 245, 250–51 (1920), a Suprema Corte citou as observações do presidente da Suprema Corte John Marshall na Convenção Constitucional da Virgínia de 1829–1830.
A advertência final de Marshall foi:
“Sempre pensei, desde minha mais tenra juventude até agora, que o maior flagelo que um Céu irado já infligiu a um povo ingrato e pecador foi um Poder Judiciário ignorante, corrupto ou dependente.”

A passagem anterior é igualmente importante.
Marshall descreveu o dever do juiz de permanecer imparcial entre governantes e governados, poderosos e impotentes, porque as decisões judiciais alcançam a propriedade, a reputação, a vida e a segurança das pessoas.
Ele estava explicando por que a independência judicial é indispensável à ordem constitucional.
E a Suprema Corte o citou em uma decisão que examinava as salvaguardas estruturais destinadas a preservar essa independência.
A independência judicial não é simplesmente um privilégio possuído pelos juízes. É uma proteção estrutural devida às pessoas cujos direitos e obrigações os juízes julgam.
