The distinction between a verdict and a settlement matters. A jury verdict is an adjudicated result reached after evidence is presented to a jury. A settlement is a negotiated resolution between the parties. Both can represent important results, but they are not legally the same thing.

Butler v. McDaniel: $250,000 Before Trial - $30 Million From the Jury

The most striking reported result is the wrongful-death and medical-malpractice matter publicly identified by Haug Barron Law Group as Butler v. McDaniel, in DeKalb County, Georgia.

The case concerned the death of Felecia Butler. Published accounts report that Butler was involved in a serious motor-vehicle collision on September 22, 2018 and subsequently received emergency medical treatment. The litigation focused on the medical evaluation and diagnosis following the accident. A perforated bowel and sepsis ultimately preceded Butler's death.

The plaintiffs' trial team included James R. Haug, Colin A. Barron, Daniel Moriarty and Evan Kline.

Most importantly for understanding Haug's own account of the case, James R. Haug reported that the highest pre-trial settlement offer was $250,000.

The jury ultimately returned a $30 million verdict. Contemporary reporting described the verdict as including $10 million for pain and suffering and $20 million for wrongful death.

According to Trial Guides, the jury deliberated for approximately 90 minutes.

The mathematical comparison is extraordinary: $30 million is 120 times the $250,000 highest pre-trial offer reported by Haug.

Haug later used the case to challenge the rhetoric surrounding so-called "nuclear verdicts." His argument is significant: looking only at the size of the final verdict can conceal what happened during discovery, negotiations and trial, what evidence the jury actually heard and whether an insurer's pre-trial valuation accurately reflected the case ultimately presented to the jury.

Whatever position one takes in the broader debate over large jury awards, the comparison illustrates precisely why victims need to understand the litigation process. An offer made before trial is an offer. It is not necessarily a judicial determination of the value of the evidence or of the legally compensable harm.

It is also important to distinguish the different stages of litigation. The publicly reported result is a $30 million jury verdict. A verdict, final judgment, appellate disposition, negotiated settlement and actual satisfaction or payment are legally distinct events. This article therefore does not state that $30 million was actually collected or paid.

What Will James R. Haug Teach in This Webinar?

This is not simply a presentation about one successful case. In Wrongful Death Litigation: A National Survey of Claims & Damages, James R. Haug will examine how wrongful-death law operates across the United States, where the rules can differ substantially from one jurisdiction to another.

The scope is unusually broad. The program moves from the historical creation of wrongful-death actions to modern disputes over standing, damages, survival claims, punitive damages, comparative fault, statutes of limitations, federal and maritime law, multi-state conflicts and tort reform.

1. Where Did Wrongful-Death Law Come From?

The webinar begins with the historical foundations of wrongful-death law, including the old common-law rule associated with Baker v. Bolton (1808), under which no civil cause of action existed at common law for wrongful death.

The program then turns to the English Fatal Accidents Act of 1846, commonly known as Lord Campbell's Act, which became an important model for American wrongful-death statutes.

This history matters because wrongful-death actions are statutory creations. The identity of the people permitted to sue, the beneficiaries entitled to recover and the damages legally available therefore depend heavily upon the governing jurisdiction.

2. Wrongful Death and Survival Actions Are Not the Same Thing

One of the central subjects is the distinction between a wrongful-death claim and a survival action.

A wrongful-death action generally concerns losses legally arising from the death and the rights granted to designated beneficiaries. A survival action preserves claims that belonged to the injured person before death and allows those claims to continue through the estate when the governing law permits.

That distinction can affect who brings the lawsuit, who receives the recovery, which damages are available and how a settlement or judgment may ultimately be allocated.

3. Who Has the Legal Right to Sue?

Haug will examine standing and beneficiary structures, including the difference between states authorizing named statutory beneficiaries to proceed and jurisdictions requiring a personal representative to bring the claim.

The program also addresses beneficiary hierarchies, distribution schemes, real-party-in-interest requirements and legal capacity.

Standing can become a jurisdictional trap that varies by state. A family can therefore have a serious underlying claim and still face major procedural problems if the wrong person commences the action.

4. How Does the Law Measure the Value of a Human Life?

This is perhaps the most profound issue in the entire webinar.

American jurisdictions do not use a single model for wrongful-death damages. Haug will compare the majority loss-to-survivors or pecuniary model, the more restrictive pure-pecuniary approach exemplified by New York, and Georgia's distinctive "full value of the life" loss-to-decedent model.

These differences are not merely academic. They can fundamentally alter what evidence matters and what a jury is legally permitted to consider.

The webinar addresses different categories and theories of damages, including economic loss, loss of support, grief, loss of consortium, hedonic damages, present value and statutory damages caps.

5. What Happens to the Claims the Victim Had Before Death?

The survival-action portion examines what claims and damages may pass to the estate, including pre-death pain and suffering, medical expenses and funeral expenses.

Haug will also address the substantial variation among states concerning pre-death pain and suffering and the availability and placement of punitive damages.

The agenda additionally includes the practical problem of coordinating liens, creditors and allocation between wrongful-death and survival claims.

6. What Happens When the Defendant Says the Victim Was Also at Fault?

Another major section concerns comparative negligence, contributory negligence and fault allocation.

The effect of the deceased person's own alleged fault can vary dramatically depending upon the governing jurisdiction. Comparative-negligence systems may reduce recovery according to the allocated percentage of fault, while contributory-negligence rules can be substantially harsher.

The webinar also addresses nonparty apportionment, immunities and damages caps.

7. A Valid Claim Can Be Lost Because of a Deadline

The webinar examines statutes of limitations, accrual and tolling, procedural rules that can determine whether a court will ever reach the merits of a claim.

It also addresses special regimes such as medical-malpractice statutes of repose and governmental notice requirements.

For victims, this may be one of the most practically important lessons of the entire program: having evidence of serious harm does not eliminate procedural deadlines.

8. Federal and Maritime Wrongful-Death Claims

The presentation is not limited to ordinary state tort litigation. Haug will examine federal and maritime wrongful-death regimes, including the general maritime remedy associated with Moragne v. States Marine Lines and issues associated with Sea-Land Services v. Gaudet.

The agenda includes the Death on the High Seas Act (DOHSA), the Jones Act and the Federal Employers' Liability Act (FELA).

9. Aviation, Civil-Rights Death Cases and Claims Against the Federal Government

The webinar also addresses wrongful-death issues arising in aviation cases, claims under 42 U.S.C. § 1983, and litigation involving the Federal Tort Claims Act (FTCA).

These contexts are especially important because ordinary state-law assumptions may not control when federal statutes, constitutional claims, federal defendants or specialized jurisdictional rules are involved.

10. Which State's Law Applies?

The webinar examines choice of law in multi-state incidents. This becomes critical when the death, alleged negligence, defendant, victim or resulting litigation connects to more than one jurisdiction.

Because states can differ sharply on standing, damages and limitations, determining which state's law governs can materially affect the litigation.

11. Current Reform Battles: Damages Caps, Grief and Tort Reform

The final substantive section turns to current legal and political disputes surrounding wrongful-death litigation.

The announced agenda includes damages-cap litigation and constitutional challenges, efforts to expand recovery for grief and noneconomic damages, including the debate surrounding New York's Grieving Families Act, and broader tort-reform initiatives.

CHAMBER OF DEPUTIES: PL BECOMES THE LARGEST PARTY

The congressional result reinforces the broader political shift visible in the presidential election. The PL elected 121 federal deputies, making it the largest party representation in Brazil's 513-member Chamber of Deputies.

According to the Chamber of Deputies, this represents an increase of 24 seats compared with the previous election. The PT-PCdoB-PV Federation finished second with 82 deputies, six fewer than in the previous election.

The PL's 121 seats represent approximately 23.6% of the Chamber. That does not constitute an absolute majority: 257 seats are required. It nevertheless gives the party considerably greater influence over legislative negotiations, coalition-building and the formation of congressional majorities.

FEDERAL SENATE: PL ELECTS 19 SENATORS AND IS PROJECTED TO HOLD 28 OF 81 SEATS

Two-thirds of the Federal Senate were renewed in 2026: 54 of the Senate's 81 seats were contested. The PL elected 19 senators, equivalent to 35.2% of all Senate seats contested in this election.

According to the Federal Senate's calculation, the PL is projected to begin 2027 with 28 senators. The PT is projected to have 9 and the MDB 8.

PP and União Brasil belong to the União Progressista Federation, but the Federal Senate counts their Senate party representations separately.

If the projected figure of 28 is confirmed when the new senators take office, the PL will have the largest single-party representation at the beginning of a Senate legislature since the promulgation of Brazil's 1988 Constitution. The previous record was 27 senators, held by the then-PMDB at the beginning of the 1999 legislature.

The PL's 19 newly elected senators also constitute a record under the 1988 Constitution for the number of senators elected by a single party in one election.

PARANÁ: SERGIO MORO ELECTED GOVERNOR IN THE FIRST ROUND

3,127,911 votes — 50.10%

With 100% of the votes counted, Sergio Moro (PL) was elected Governor of Paraná in the first round. He received 3,127,911 votes, equivalent to 50.10% of the valid votes.

A former federal judge, former Minister of Justice and senator on leave, Moro ran as part of an alliance formed by Podemos, PL and NOVO, with Edson Vasconcelos (PL) as his running mate for Vice Governor.

PARANÁ ELECTS FILIPE BARROS AND DELTAN DALLAGNOL TO THE FEDERAL SENATE

Paraná voters elected Filipe Barros (PL) and Deltan Dallagnol (NOVO) to the state's two Senate seats contested in 2026.

Both were elected to the Federal Senate for the first time. Their eight-year terms are scheduled to run from February 1, 2027, through January 31, 2035.

IMPORTANT LEGAL NOTE — DELTAN DALLAGNOL: Dallagnol was elected, but his candidacy remains sub judice. The Federal Senate reported that a monocratic decision denying his registration was suspended by TSE President Justice Kassio Nunes Marques pending consideration by the full Superior Electoral Court. According to the Senate, if his ineligibility is ultimately confirmed, a new election would have to be held in Paraná for that Senate seat.

The Paraná result is politically significant: Moro won the state government in the first round, while Barros and Dallagnol won the two Senate seats contested by Paraná.

Twenty state governorships were decided on October 4. The remaining six states and the Federal District will hold gubernatorial runoffs on October 25.

ANALYSIS — WHAT DID THE BRAZILIAN PEOPLE SAY ON OCTOBER 4?

The first round of Brazil's 2026 general election cannot be understood solely as a presidential contest between Flávio Bolsonaro and Luiz Inácio Lula da Silva. The Brazilian people voted simultaneously for the Presidency, the Chamber of Deputies, two-thirds of the Federal Senate, state governments and state legislatures. Viewed together, the results reveal a broader redistribution of political power.

At the presidential level, Flávio Bolsonaro finished first with 47.03% of the valid vote, against Lula's 45.16%. The margin — 2,224,965 votes — is significant, but neither candidate obtained the absolute majority of valid votes required for a first-round victory. The presidency therefore remains to be decided by Brazilian voters on October 25.

The congressional results have a different institutional character. The PL will enter the next Chamber of Deputies as its largest party, with 121 of 513 seats. In the Senate, the party elected 19 of the 54 senators chosen in 2026 and is projected to hold 28 of the 81 Senate seats when the new legislature begins.

At the state level, the PL also won the largest number of governorships decided in the first round, with five victories. The PSD won four; PT and Republicanos won three each; PP won two; and MDB, PSDB and Podemos won one each.

THE SO-CALLED “BLUE WAVE” THEREFORE HAS AN OBJECTIVELY MEASURABLE INSTITUTIONAL DIMENSION.

It is visible simultaneously in Flávio Bolsonaro's first-place presidential finish, the PL's emergence as the largest party in the Chamber of Deputies, the election of 19 PL senators, the party's projected 28-seat representation in the Federal Senate, and its five first-round gubernatorial victories.

The result does not establish absolute control of Brazil's political institutions by a single party. It does demonstrate a substantial redistribution of political representation produced by Brazilian voters on October 4, 2026.

Political Strength Is Not the Same as Absolute Control

The PL cannot govern Congress alone. An absolute majority requires 257 of the 513 members of the Chamber of Deputies and 41 of the 81 members of the Federal Senate.

A constitutional amendment requires an even higher threshold: three-fifths of the members of each chamber, in two rounds of voting — 308 deputies and 49 senators.

The institutional significance of the election therefore lies in the redistribution of representation, bargaining power, coalition-building capacity, legislative influence and the ability to support, negotiate, condition or block measures requiring qualified majorities.

The Brazilian People Will Have the Final Word

The congressional and first-round gubernatorial results have already altered Brazil's political landscape for the years ahead. But the Presidency remains undecided.

On October 25, 2026, the Brazilian people will return to the polls to choose between Flávio Bolsonaro (PL) and Luiz Inácio Lula da Silva (PT).

The PL's 121 deputies represent approximately 23.6% of the 513 seats in the Chamber. The party increased its representation by 24 seats compared with the previous election.

This does not give the PL an absolute majority: 257 seats are required. It does, however, substantially strengthen the party's role in coalition-building, legislative negotiations and the formation of congressional majorities.

Of the 54 Senate seats contested in 2026, the PL won 19 — approximately 35.2% of all seats contested.

Paraná voters elected Filipe Barros (PL) and Deltan Dallagnol (NOVO) to the two Federal Senate seats contested in the 2026 election. They defeated, among others, Alexandre Curi (Republicanos) and Gleisi Hoffmann (PT).

Barros and Dallagnol campaigned within the same political alliance built around Sergio Moro's candidacy for Governor of Paraná. Their election means that the two Senate seats renewed by Paraná in 2026 will be occupied by candidates from PL and NOVO.

Both men will serve their first terms as senators. Their eight-year mandates begin on February 1, 2027 and end on January 31, 2035.

THE PARANÁ RESULT IS PARTICULARLY SIGNIFICANT: the same electoral coalition that carried Sergio Moro to the governorship also succeeded in electing both of its leading Senate candidates, consolidating a substantial share of Paraná's representation in both the state and federal political arenas.

When the Presidency, Chamber of Deputies, Federal Senate and state governments are examined together, a broader redistribution of political power becomes visible.

In the presidential contest, Flávio Bolsonaro received 47.03% of the valid votes against Lula's 45.16%. Brazil nevertheless remains electorally divided, and the Presidency will be decided only in the second round.

In Congress, however, the consequences are more structural. The PL emerged as the largest caucus in the Chamber of Deputies, with 121 seats, while its projected Senate caucus reaches 28 of 81 senators.

The Senate result is particularly significant. The PL won 19 of the 54 seats contested in 2026. Senators elected in 2026 will serve eight-year terms, meaning that the institutional consequences of this election extend far beyond the next presidential term.

Paraná provides a particularly clear example of this broader electoral movement: Sergio Moro won the governorship in the first round, while Filipe Barros and Deltan Dallagnol won the state's two Senate seats.

This does not mean that a single political party controls Brazil's institutions. Brazil's political system remains fragmented and coalition-dependent.
